Terms of use
The rules for using this website and our applications. Your commercial relationship with us, if you have one, is governed by your service agreement rather than this page.
These terms cover this website and the general rules for using our applications. They are not your contract with us. If your organisation subscribes to SmartSCM or another system we built, the commercial relationship is governed by the signed service agreement between us — and if anything here conflicts with that agreement, the agreement wins.
1. Accepting these terms
This website, smartinfotechnologies.com, is operated by Smart Info Technologies LLC (“SIT”, “we”, “us”), a limited liability company registered in Kansas, United States. Our mailing address is 7111 W 151 Street, Overland Park, KS 66223.
By using this site you accept these terms. If you do not accept them, please do not use the site.
2. Using this website
We give you permission to view this site and to print or download pages from it for your own reference, or to share internally while evaluating our products. That permission does not transfer ownership of anything, and it ends if you breach these terms.
We try to keep the site available, but we do not guarantee it. We may change, suspend or withdraw any part of it without notice.
3. What you must not do
You must not:
- use the site for any unlawful purpose, or in a way that breaches these terms
- attempt to gain unauthorised access to the site, its servers, or any connected system
- probe, scan or test the vulnerability of the site, or interfere with its operation — if you believe you have found a security issue, tell us at sales@smartinfotechnologies.com and we will engage with you in good faith
- scrape, harvest, mine or systematically extract content or data from the site, including for the purpose of training machine learning models, without our written permission
- use automated systems to submit our forms, or submit false or misleading information through them
- copy, republish or redistribute substantial parts of the site's content for commercial purposes
- remove or alter any copyright, trade mark or other proprietary notice
4. Using our applications
If you are an authorised user of SmartSCM or another SIT-built application — typically because your employer subscribes — the following applies to you personally, in addition to whatever your employer has agreed with us.
- Use the application only for your employer's legitimate business purposes, and only within the permissions you have been granted.
- Do not attempt to access data belonging to another organisation, another user, or any part of the system you have not been given access to.
- Do not reverse engineer, decompile, disassemble or attempt to derive the structure of the framework or the application, or use it to build a competing product.
- Do not use automated means to extract data at volume beyond your normal working use, except through interfaces we have provided for the purpose.
- Do not upload malicious code, or content you have no right to upload.
- Tell us or your administrator promptly if you become aware of a security problem or of access you should not have.
We may suspend access where we reasonably believe it is necessary to protect the system, other users, or a customer's data. Where we do, we will tell the customer's administrator as soon as we practically can.
5. Accounts and credentials
Sign-in is handled by a federated identity provider, and we never hold your password. You are responsible for keeping your credentials confidential and for activity carried out under your account. Do not share an account between people — every customer application supports individual user accounts, and shared logins defeat the audit trail your employer relies on.
If you think your credentials have been compromised, tell your administrator and us immediately.
6. Intellectual property
We own, or are licensed to use, everything on this site: the text, layout, graphics, screenshots and code, together with the “Smart Info Technologies” and “SmartSCM” names and logos. Nothing here grants you a licence to use our marks.
We own the underlying metadata-driven framework and all rights in it. Where we build an application for a customer, that customer owns their data, their process design, their screen and workflow configuration, and any custom development commissioned specifically for them — as set out in their agreement with us. Nothing in these website terms changes that allocation.
Screenshots shown on this site are representative and use sample data. They are illustrations, not a specification of what any particular system does or will do.
7. What you send us
Do not send us confidential information through the contact form. If you need to share something sensitive, ask us and we will arrange a secure route or sign a non-disclosure agreement first.
If you send us feedback, suggestions or ideas about our products, you agree we may use them without obligation, attribution or payment. This does not affect the confidentiality of anything covered by a non-disclosure agreement already in place between us.
8. Accuracy and forward-looking statements
We work to keep this site accurate, but product capabilities change and descriptions here are summaries, not specifications. Nothing on this site forms part of a contract or constitutes an offer.
Some statements describe what we intend to build — for example extending SmartSCM beyond transportation into other parts of the supply chain. These are statements of current intent, not commitments to deliver by any date. Please do not make a purchasing decision on the basis of a capability we have not yet shown you working.
9. Third-party links and services
This site links to third-party sites and uses third-party services, including Google Analytics, Google reCAPTCHA and Google Fonts. We do not control those sites or services and we are not responsible for their content or their practices. Their own terms and privacy policies apply to your use of them.
10. No warranty on website content
This website is provided “as is”. To the fullest extent permitted by law, we exclude all warranties, conditions and representations about the site, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.
This section applies to the website only. Warranties relating to the applications we provide to customers are dealt with in the relevant service agreement, and nothing here reduces them.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss arising from your use of this website, or for any loss of profit, revenue, business, goodwill or data.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
Again, this section governs the website. Liability under a customer service agreement is governed by that agreement.
12. Privacy
Our privacy policy explains what we do with personal information collected through this site. Please read it — it forms part of your use of the site.
13. Changes
We may update these terms. The date at the top shows the current version, and your continued use of the site after a change means you accept it. Where a change is material and affects existing customers, we will tell them directly rather than rely on them noticing.
14. Governing law
These terms and any dispute arising from them are governed by the laws of the State of Kansas, United States, without regard to its conflict of laws rules. The state and federal courts located in Johnson County, Kansas will have exclusive jurisdiction, and you consent to that jurisdiction.
